»Entrepreneurial Rights and Global Justice«

Project outline:
Entrepreneurial Rights (ER) are conceived as a bundle of rights of individuals to engage in economic activity and include freedoms and opportunities that allow entrepreneurs to contract, make deals, issue shares or bonds to raise investment capital, separate business assets from personal assets and form management hierarchies. ER are not novel. They exist in many legal systems and have been extensively studied as part of the private law. What is innovative is the perspective that sees them as fundamental in a way that makes it appropriate to consider them human rights and the emphasis on their instrumental value to achieve global justice. My research project has four aims: a) to offer a list of the rights that an adequate bundle of ER should include; b) to define correlative duties and classify them according to the type of action they require – for instance, duties to protect, duties to respect or duties to facilitate; c) to identify a group of duty-bearers that includes states and non-state actors, and suggest possible relations between the obligations they have – the obligations of the non-state actors might be subsidiary and/or simultaneous to those of the states; d) to clarify the connection between ER and human rights and identify a set of ER that qualify as human rights. Jahel Queralt Lange recieved her Ph.D. in Political Science at the Pompeu Fabra University in Barcelona in 2012. Her thesis was titled »Justice and Responsibility«.
